Terms and Conditions for Unpose

Welcome to Unpose! These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Unpose ("we", "us", or "our") governing your access to and use of the Unpose mobile application (the "App"), our website at https://unpose.app, and related services (collectively, the "Services").

By downloading, accessing, or using Unpose, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

1. Description of the Services

Unpose is a mobile photography guidance and camera application designed to assist photographers and subjects with composition, framing, and posing. Key features include:

  • Curated Pose Guides: Access to visual pose overlays for solo, couple, and group portraits.
  • Live Camera Overlays: Real-time alignment guides displayed over your device's live camera preview.
  • Custom Pose Creation: Tools to create personal pose guides from reference photos in your library using on-device background removal.
  • Collections & Camera Tools: Tools to organize poses, save favorites, and utilize camera assists (level, grid, zoom, exposure).
Important Note on Photos: Photos you capture using the Unpose camera are stored directly and exclusively on your local device's photo library. Unpose does not host, store, or own your finished photographs.

2. Eligibility & Accounts

  • Age Requirement: You must be at least 13 years old (or 16 in the European Economic Area) to use the App.
  • Account Registration: You may access certain features by signing in through third-party authentication providers (Sign in with Apple or Google Sign-In). You agree to provide accurate information and keep your login credentials secure.
  • Account Security: You are solely responsible for all activities that occur under your account. Notify us immediately at support@unpose.app if you suspect unauthorized access.

3. Subscriptions, Free Trials, and In-App Purchases

Certain premium features of the App are available through paid auto-renewable subscriptions ("Unpose Pro").

A. Subscription Tiers & Billing

  • Unpose Pro Monthly: Billed on a recurring monthly basis.
  • Unpose Pro Annual: Billed on a recurring annual basis.

Exact pricing and currency are displayed within the App on the paywall screen prior to purchase and may vary by region or platform.

B. Free Trials & Introductory Offers

  • Eligible new subscribers may receive a free trial (e.g., 7-day free trial) when selecting the annual subscription.
  • Trial Expiration: Unless you cancel your trial at least 24 hours before the trial period ends, your subscription will automatically convert into a paid recurring subscription and your Apple ID or Google Play account will be charged the displayed annual price.
  • Any unused portion of a free trial will be forfeited if you purchase a subscription prior to trial expiration.

C. Automatic Renewal & Cancellation

  • Auto-Renewal: Subscriptions automatically renew for the same period and price unless auto-renewal is turned off at least 24 hours prior to the end of the current billing cycle.
  • Billing: Your Apple ID or Google Play account will be charged for renewal within the 24 hours prior to the end of the current period.
  • How to Cancel: You can manage or cancel your subscription at any time through your device's account settings:
    • iOS: Go to Settings → [Your Name] → Subscriptions → Unpose → Cancel Subscription.
    • Android: Go to Google Play Store → Profile Icon → Payments & Subscriptions → Subscriptions → Unpose → Cancel.
Important: Uninstalling the App or deleting your Unpose account does not cancel your underlying Apple or Google Store subscription. You must cancel via your device's store settings.

D. Refunds

All purchases and subscription fees are billed and managed directly by Apple (App Store) or Google (Google Play). Refund requests must be submitted directly to the respective store according to their refund policies:

4. User Content & Acceptable Use

A. Your Content

When you import photos into the App to create custom pose guides ("User Content"), you retain all ownership rights in your images. You grant Unpose a limited, non-exclusive license to process and store your custom pose assets solely for the purpose of providing the Services to your authenticated account.

B. Prohibited Conduct

You agree not to use the App to:

  1. Upload, frame, or process images that are illegal, sexually explicit, abusive, harassing, defamatory, or violate another person's intellectual property or privacy rights.
  2. Photograph individuals without their knowledge or consent where there is a reasonable expectation of privacy.
  3. Reverse-engineer, decompile, extract source code, or tamper with the security of the App.
  4. Use automated bots, scrapers, or exploits to access the Services or download pose assets.
  5. Resell, distribute, or commercially sublicense Unpose curated pose assets.

5. Intellectual Property Rights

  • All rights, title, and interest in and to the App—including curated pose illustrations, artwork, trademarks, logo, design system, user interfaces, code, algorithms, and documentation—are the exclusive property of Unpose and its licensors.
  • We grant you a personal, non-transferable, non-exclusive, revocable license to download and use the App for your personal, non-commercial use on compatible devices.

6. Physical Safety & Photography Disclaimer

  • Situational Awareness: Photography often occurs in busy, unfamiliar, or outdoor environments. You are solely responsible for exercising caution and maintaining awareness of your physical surroundings (e.g., traffic, pedestrians, cliffs, ledges, water, stairs) while using the camera.
  • No Guarantee of Results: Unpose is an educational and compositional aid. We do not guarantee specific photographic quality, social media performance, or subjective aesthetic outcomes.

7. Account Termination and Deletion

  • Termination by You: You may stop using the Services at any time. You can permanently delete your account and all associated cloud data directly within the App under Settings → Account → Delete Account.
  • Termination by Us: We reserve the right to suspend or terminate your access to the App if you violate these Terms or engage in fraudulent or unlawful activity.

8. Disclaimers & Limitation of Liability

A. "As Is" Basis

The Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

B. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Unpose, its officers, directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, photos, profits, or goodwill) arising out of or related to your use of or inability to use the App.

Our total aggregate liability for any claims arising under these Terms shall not exceed the amount paid by you to Unpose during the twelve (12) months preceding the event giving rise to liability.

9. Changes to These Terms

We may revise these Terms from time to time. When changes are made, we will update the "Last Updated" date at the top. If changes are material, we will provide reasonable notice (such as an in-app notice or email). Your continued use of the App following the posting of revised Terms constitutes your acceptance.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the operating entity resides, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved in the competent courts of that jurisdiction.
